Widow from Ahmedabad Wins Insurance Battle and Gets Rs 10 Lac

This is a good news about people getting justice at the end. These days, it is sad that we have to fight back for our rights but it is good if consumer wins. After the insurance company rejected her claims, Daksha Gandhi approached CERC and consumer court who helped her win the 3-year battle.

After two years of running from pillar to post, 57-year-old Daksha has won the battle against a insurance company that refused to pay her the amount due from her late husband’s insurance policy. With support from the Consumer Education and Research Centre (CERC), the widow has been awarded Rs10 lakh—she will use the money for the weddings of her daughters Disha (26) and Yesha (22).

In 1999, Daksha’s husband Avnish Gandhi purchased a Janta Personal Accident (JPA) policy — a one time premium policy from National Insurance Company Limited (NICL)—fora term of 15 years with an assured sum of Rs 10 lakh. Unfortunately, Avnish died in an accident in December 2010. As a nominee, Daksha contacted the insurance company in 2011 to claim the money. But she was informed the policy stands cancelled since the company cancelled all JPA policies in 2005 and therefore is not liable to pay any claim to her. “The insurance company had issued a public notice in a local paper about the cancellation of policy and asked consumers to collect the proportionate premium for the remaining period from the group agents after submitting original policy documents. However, this notice was not addressed to any particular policy holder and she was never intimated about it.

Finally, a complaint was filed with the consumer forum in January 2013 where the insurance company’s lawyer argued that since the policy was bought through a group agent, the company could not oblige the claim. However, the court passed a judgement in Daksha and CERC’s favour on October 10, 2013, ordering the insurance company to give Rs 10 lakh with an interest of nine per cent from January 12, 2011 along with Rs 3000 for compensation and Rs 1500 for expenses.
